Hand-Fetish-Projects® Open Call — Terms of Service
1. Who You're Agreeing With
"Hand-Fetish-Projects®" ("HFP") is a trademark. The entity or individual currently operating it and responsible for these Terms is identified on HFP's Legal Information page, which is incorporated into these Terms by reference and may be updated from time to time as HFP's operating structure changes.
2. Acceptance of Terms
By submitting work to an HFP open call, you ("you," "the artist," "the entrant") agree to be bound by these Terms of Service. If you do not agree, do not submit.
3. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to submit. Open globally — no restriction by country, nationality, or ethnicity.
Note: due to restrictions on cross-border PayPal payments involving Vietnam, entrants located in Vietnam may currently be unable to complete payment for this open call. This is a limitation of the payment platform used, not a restriction imposed by HFP, and may change if payment options expand in the future.
4. Ownership — What You Keep
You retain full copyright ownership of your original artwork at all times. Submitting to an HFP open call does not transfer copyright in your underlying work to HFP. What you grant HFP is a set of specific, limited licenses, described in Section 6.
5. Your Warranties & Representations
By submitting, you represent and warrant that:
5.1 You are the sole original creator of the submitted work, and you own all rights necessary to grant the licenses described in Section 6 — or, if the work involves any third-party material, you hold all permissions required to submit and license it as described here.
5.2 The work does not infringe, and has never infringed, the copyright, trademark, privacy, publicity, or any other right of any third party.
5.3 No third party holds any competing claim, license, or interest in the work that would conflict with the rights you're granting HFP.
5.4 These warranties remain true for as long as HFP holds or exercises any license under these Terms.
6. License Granted to HFP
If your work is selected, you grant HFP a non-exclusive, worldwide license to use your submitted work — and, where applicable, documentation/images of the physical exhibited piece — for the following specific purposes:
6.1 Exhibition & Documentation. To reproduce, print, and physically exhibit your work as part of the relevant call, and to photograph, film, and otherwise document the exhibition — including your work — for HFP's own archive, marketing, press, and social media use, in perpetuity.
6.2 Publication. If selected for the artbook tier, to reproduce your work in the relevant artbook/zine, in print and/or digital form.
6.3 Archive & Reactivation. To retain documentation and reproductions of your work in HFP's ongoing archive, and to re-use that material in future exhibitions, publications, or curatorial contexts ("reactivation"), with credit to you as the original artist.
6.4 Retail Products. To produce and sell products derived from your work — alone or bundled with other selected artists' work, such as (but not limited to) prints, postcard sets, or other physical or digital goods — at exhibitions and online, for the period and on the terms described in Section 8. Continued sale beyond that period requires a separate agreement with you.
None of the above licenses are exclusive. You remain free to exhibit, publish, license, or sell your own original work elsewhere, in any form, at any time.
7. Third-Party Disputes — No Liability to HFP
HFP does not independently verify that submitted work is original or that the entrant holds the rights they warrant in Section 5. You are solely responsible for ensuring you have the right to submit and license your work.
If a third party asserts a claim that a submitted work infringes their rights, HFP may, at its sole discretion and without liability to you: suspend or remove the work from any exhibition, publication, or sale; withdraw it from further use under the licenses in Section 6; and pause or withhold any related revenue share or payment pending resolution.
HFP is not a party to, and bears no responsibility or liability for, any dispute between you and a third party concerning ownership or originality of a submitted work. Under Section 5 and Section 9 below, you agree to indemnify and hold HFP harmless from any claim, loss, liability, or cost (including reasonable legal fees) arising from a breach of your warranties or from any such third-party dispute.
8. Commercial Terms for Derivative Products
HFP may produce and sell products using licensed reproductions of selected work. Which of the following general terms applies to a specific product depends on the nature of that product, not its name — new products introduced later fall under whichever category below describes them. Product-specific details (pricing, quantities, etc.) are disclosed on the relevant call or product page.
8.1 Single-Artist Products. For a product derived primarily from one artist's individual work (for example, a limited edition print), revenue from each unit sold is split between the artist and HFP at a stated percentage — currently 55% to the artist / 45% to HFP, reflecting HFP's production and shipping costs — unless a different percentage is disclosed for a specific product.
8.2 Multi-Artist Bundled Products. For a product bundling work from more than one selected artist (for example, a themed set), revenue from each unit sold is split evenly among the artists included in that specific bundle, for a period of six (6) months from the relevant exhibition date. After that window, HFP may continue selling any remaining stock without further payment. If HFP later produces a new print run of that same bundled product, a one-time reactivation payment — split evenly among the artists originally included in it — is paid at the time of that new run, consistent with HFP's archive and reactivation practice (Section 6.3).
8.3 HFP-Compiled Publications. For a publication where HFP holds the design, layout, editorial selection, and compilation (for example, a shortlist or exhibition-document artbook), HFP retains all revenue from its own sales, in any format. Artists whose work is included hold no ownership interest in the compiled design — only in their individual artwork as reproduced within it — and nothing here limits an artist's right to reproduce, print, or sell their own individual artwork independently of the publication, at any time. In exchange for inclusion, artists typically receive preferential terms to purchase physical copies (a discounted price, plus a further wholesale discount for bulk purchase, resellable at any price the artist chooses — HFP does not restrict or claim any revenue from that resale) and a complimentary digital copy for personal and portfolio use; that digital copy may not be reproduced, printed for resale, or redistributed to any third party.
8.4 HFP's Own Merchandise. Products bearing HFP's own designs, not derived from any submitted artwork, are HFP's sole property, and any revenue from their sale belongs entirely to HFP.
9. Indemnification
You agree to indemnify, defend, and hold harmless HFP, its operators, and collaborators from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of any warranty in Section 5; (b) any third-party claim described in Section 7; or (c) your violation of these Terms.
10. Refunds
If a call's exhibition or event cannot proceed as planned, HFP will refund the submission fees paid by entrants for that call, provided the refund is issued before the event was originally scheduled to take place. If a force majeure event disrupts or prevents the event after HFP has begun carrying it out, no refund will be issued.
Purchases of discounted or wholesale products (for example, pre-ordered prints, postcard sets, or artbook copies) are refunded only if HFP fails to deliver the ordered goods. Placing an order does not, on its own, entitle you to a refund if you change your mind afterward. To request a refund or raise an issue with an order, contact HFP directly by email — each case is handled individually.
11. No Guarantee of Selection
Submission does not guarantee inclusion in any exhibition, publication, or tier. Selection is made entirely at HFP's discretion following its curatorial process. Payment of a higher fee tier does not increase, and payment of a lower fee tier does not decrease, an entrant's likelihood of selection.
12. HFP's Rights
HFP reserves the right to disqualify any submission that violates these Terms, to modify submission mechanics with reasonable notice via the relevant submission page, and to decline to select any submission for any or no reason, at its sole discretion.
13. Limitation of Liability
To the maximum extent permitted by law, HFP's total liability arising from your participation in an open call is limited to the fee you paid. HFP is not liable for indirect, incidental, special, or consequential damages of any kind.
14. Privacy
HFP collects the personal data necessary to administer submissions, fees, and any prizes or product sales (name, email, location, and, if selected, shipping and payment details). This data is not sold to third parties. [A fuller, standalone Privacy Policy is still needed — see meta-notes.]
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of Vietnam, without regard to its conflict-of-law principles. If a dispute arises out of or relating to these Terms or your participation in an HFP open call, please contact HFP directly first so we can try to resolve it informally. If it cannot be resolved that way, the dispute will be subject to the exclusive jurisdiction of the competent courts of Vietnam.
16. General Provisions
16.1 Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
16.2 Entire Agreement. These Terms, together with the submission page for the relevant call, constitute the entire agreement between you and HFP regarding your participation.
16.3 Assignment. HFP may assign its rights and obligations under these Terms; you may not, without HFP's written consent.
16.4 No Waiver. HFP's failure to enforce any provision is not a waiver of its right to do so later.
16.5 Force Majeure. HFP is not liable for delay or failure to perform caused by circumstances beyond its reasonable control (including but not limited to natural disaster, government action, or shipping/logistics disruption).
17. Changes to These Terms
HFP may update these Terms from time to time. Material changes will be reflected with an updated date at the top of this page. Continued participation after changes constitutes acceptance.
These Terms take effect for you at the moment you accept them — for example, by submitting a piece to a given call. If HFP updates these Terms afterward, the update applies to new submissions and to your continued participation going forward. It does not retroactively alter the terms governing a submission you already made and agreed to under a prior version.
